Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Evontar platform, including the website at evontar.com and the application at app.evontar.com(collectively, the “Service”), operated by Evontar (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

1. Using Evontar

Eligibility

You must be at least 18 years old to create an account. By using Evontar, you represent that you meet this requirement and have the authority to agree to these Terms on behalf of any organization you represent.

Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@evontar.com if you suspect unauthorized access.

Acceptable Use

You agree not to use Evontar to:

• Post content that is unlawful, harassing, defamatory, or otherwise harmful
• Transmit spam or unsolicited commercial messages
• Attempt to gain unauthorized access to other users’ accounts or community data
• Reverse engineer, decompile, or attempt to extract the source code of the platform
• Use the Service in a way that violates any applicable law or regulation

2. Your Content

You retain ownership of content you submit to Evontar — announcements, documents, poll responses, and other community data. By submitting content, you grant us a limited license to store, process, and display that content solely for the purpose of providing the Service to you and your community members.

You are responsible for ensuring that the content you post does not infringe any third-party rights and complies with applicable laws.

3. Plans and Billing

Service Tiers

Evontar offers four subscription tiers based on the number of active members in your organization:

• Free— up to 20 members, $0/month. No credit card required.
• Starter— 21 to 200 members, $29/month.
• Growth— 201 to 500 members, $49/month.
• Scale— 501+ members, $0.098 per member per month (flat rate).

Annual Billing Discount

Starter, Growth, and Scale tiers are available on an annual billing cycle at a 17 % discount. Annual pricing: Starter $290/year, Growth $490/year, Scale 17 % off the equivalent monthly total. Annual subscriptions are billed in advance for the full year.

Dues Collection Add-on

Any organization on a paid tier (Starter, Growth, or Scale) may enable the Dues Collection add-on for an additional $19/month ($190/year on annual billing). This add-on provides integrated payment processing for member dues and assessments.

Cancellation and Refunds

You may cancel your subscription at any time from your organization settings. If you cancel within 14 days of a new subscription or renewal, you are entitled to a full refund — no questions asked. After 14 days, your plan continues through the end of the current billing period; no further charges will be made.

Price Changes

We will provide at least 30 days’ notice before changing the price of any paid plan. Continued use after the effective date constitutes acceptance of the new pricing.

4. Service Availability

We aim to keep Evontar available at all times but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages beyond our control. We will endeavor to provide advance notice of planned downtime.

5. Termination

Cancelling Your Organization

You may cancel your organization at any time from Settings → Cancel Organization inside the app. When you cancel:

• Your organization continues to operate normally for 30 days— members can sign in, post, and use the platform as usual.
• You can download your data from the cancellation page. The member roster is exportable as a CSV directly from the page; other data (announcements, events, documents, finances) can be requested by emailing support@evontar.com before the effective date.
• You can restore the organization at any point during the 30-day window directly from the same page.
• After 30 days, all organization data — members, announcements, events, documents, reservations, finances — is permanently deleted and cannot be recovered.

Suspension and Termination by Evontar

We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice. Upon termination, your right to use the Service ceases, and we will delete your data in accordance with our Privacy Policy.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVONTAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

8. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Travis County, Texas.

9. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or a prominent notice in the application. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
